Terms of Service

These Terms of Service (“Terms”) govern access to and use of the VaxCheck platform and related services (“Services”) provided by VaxCheck. By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
1. Purpose of the Services
VaxCheck provides digital tools to assist pharmacists in conducting vaccine reviews with patients. The Services collect demographics, vaccine histories, and relevant medical information, and generate prompts or educational outputs.
The Services are intended to support, not replace, the professional judgment of pharmacists and other licensed health-care providers.
2. No Medical Advice
- VaxCheck does not provide medical advice, diagnosis, treatment plans, or prescriptions.
- All outputs generated by the Services are for informational purposes only and must be validated by a pharmacist or other qualified professional.
- Users must not rely solely on the Services in making patient care decisions.
3. Beta Testing Acknowledgment
- The Services are currently in beta testing and remain under active development.
- The Services may contain errors, bugs, or incomplete features, and functionality may change without notice.
- Feedback provided by users will be used to improve the Services.
- By using the Services during beta, you acknowledge these limitations and agree to apply your professional judgment accordingly.
4. User Responsibilities
By using the Services, you agree:
- You are solely responsible for all clinical decisions, counseling, and patient care.
- You will ensure patients understand how their information is used and obtain any required consent.
- You will comply with all applicable laws, regulations, and standards of practice.
5. Privacy and Personal Health Information
- You may enter personal health information (PHI) into the Services, including demographics, contact details, medical conditions, and vaccine history.
- You, as the pharmacist or health-care provider, remain the custodian of PHI and are responsible for compliance with privacy laws such as PHIPA (Ontario) and PIPEDA.
- VaxCheck acts as a service provider (“affiliate”) to your pharmacy or organization and processes PHI only as directed.
- PHI will not be used by VaxCheck for independent purposes. De-identified or aggregated data may be used for analytics, quality improvement, and research as permitted by law.
6. Consent and Patient Rights
- You are responsible for obtaining and documenting patient consent.
- Patients may withdraw consent at any time. You must then determine whether services can still be delivered.
7. Security and Data Storage
- Data is stored on secure servers located in Canada. Limited information may be processed by third-party service providers, subject to contractual safeguards.
- All storage and processing of data is designed to comply with applicable Canadian privacy legislation, including PHIPA (Ontario) and PIPEDA.
- VaxCheck uses administrative, technical, and physical safeguards to protect information, but absolute security cannot be guaranteed.
- Users will be notified of any breaches that create a reasonable risk of harm, as required by law.
8. Intellectual Property
- All rights, title, and interest in and to the Services, including software, algorithms, content, and documentation, are owned by VaxCheck or its licensors.
- Users are granted a limited, non-exclusive, non-transferable license to use the Services for professional purposes only.
- Users may not copy, modify, reverse engineer, distribute, or create derivative works based on the Services.
9. Accuracy and Completeness
- While VaxCheck strives to provide accurate, current, and evidence-based information, it does not guarantee completeness or error-free outputs.
- Algorithms may rely on third-party data or evolving guidelines.
- You acknowledge that professional judgment is required to validate all outputs before applying them in patient care.
10. Limitations of Liability
- The Services are provided “as is,” without warranties of any kind, express or implied.
- To the maximum extent permitted by law, VaxCheck will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of or reliance on the Services.
11. Indemnification
You agree to indemnify, defend, and hold harmless VaxCheck, its officers, employees, and affiliates from any claims, damages, or costs (including legal fees) resulting from:
- Misuse of the Services;
- Reliance on outputs without professional validation;
- Breach of laws, standards, or professional obligations.
12. Use by Minors
The Services are intended for use by licensed pharmacists and authorized health-care providers only. They are not intended for direct use by patients or minors.
13. Third-Party Content and Links
The Services may include links to third-party websites or resources. VaxCheck does not endorse and is not responsible for third-party content, policies, or practices.
14. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada. Users agree to the exclusive jurisdiction of the courts of Ontario.
15. Modifications to Terms
VaxCheck may revise these Terms at any time. Updated Terms will be posted on the website, and continued use of the Services after changes constitutes acceptance.
16. Termination
VaxCheck may suspend or terminate access to the Services at its discretion, without notice, for violations of these Terms or misuse of the Services.
